Why is the Board of Regents Leadership “Bleeding” Public Schools by Allowing Charter Expansion?

Charter Schools were created in the late 1980s as “engines of innovation,” schools in which innovative and unique teaching techniques can be modeled; Albert Shanker, the President of the American Federation of Teachers was a supporter.

As charter laws blossomed across the nation Shanker withdrew his support; instead of “engines of innovation” charter schools were marketed as schools competing with public schools: let the schools with the highest achievement survive. Nobel Prize economist and “free market” advocate Milton Freedman became the philosophical foundation of charter schools.

Today many charter schools have moved in a somewhat different direction; seeking to educate the highest achievers in poor communities. WEB DuBois, a sociologist and founding member of the NAACP advocated the education of the “Talented Tenth,”

“The Negro race, like all races, is going to be saved by its exceptional men. The problem of education, then among Negroes must first of all deal with the Talented Tenth; it is the problem of developing the best of this race that they may guide the mass away from the contamination and death of the worst, in their own and other races”

Public schools educate whoever walks through their doors, regardless of economic status, disability and language barriers.

 The charter school law requires a lottery to gain admittance and charter schools advertise widely to enlarge the pool and attract “upwardly socially mobile” parents, in other words, the “talented tenth.”

 The New York State Charter School law prohibits gifted charter schools and requires charter schools to enroll students with disabilities, English language learners and Title 1 eligible students.

 a  charter school designed to provide expanded learning opportunities for students at-risk of  academic  failure or students with disabilities and English language learners; and provided, further,  that  the  charter   school shall demonstrate  good  faith  efforts  to attract and retain a comparable or greater enrollment of  students  with  disabilities,  English  language learners,  and  students  who  are  eligible applicants for the free and reduced price lunch program when compared to the enrollment figures for such  students  in  the  school  district in which the charter school is located.

If you look at charter school data virtually every charter school enrolls fewer than the “comparable” percentages required in the law. The reason is abundantly clear, students with disabilities and English language learners frequently have lower standardized test scores, impact the charter renewal process and are more costly to educate, i.e., lower class size = more teachers.

Benchmark 1: Proficiency at the elementary/middle school level shall be defined as achieving a performance level of 3 or higher on Grade 3-8 state assessments in ELA, math,

Benchmark 9: The school is meeting or making annual progress toward meeting the enrollment plan outlined in its charter and its enrollment and retention targets for students with disabilities, English language learners, and students who are eligible applicants for the free and reduced priced lunch program; or has demonstrated that it has made extensive good faith efforts to attract, recruit, and retain such students.

At the June 8th Regent Meeting, a six-hour remote meeting half the meeting was debate over the renewal and expansion of grades in charter schools.

A Buffalo charter school requested a re-vote on a grade extension that had been denied at the May meeting, after a clarification the Board was agreeable to grant the extension; however, the school had failed to meet “comparable” percentage of SWD and Ell students over four years, and, was required to file an Corrective Action Plan,

February 2019, the school was required by NYSED to provide a Corrective Action Plan (CAP) to increase enrollment of students with disabilities (SWDs) and English language learners (ELLs)/Multilingual learners (MLLs) to meet the proportions enrolled in the district of location. In the spring of 2020, the school was required to address these same enrollment issues. The school is currently implementing the specific strategies outlined in the CAP and provides quarterly progress reports and updates to the NYSED Charter School Office (CSO). The CAP will be closely monitored, and the Department will report to the Regents, as necessary.

 Regent Collins, representing the Buffalo region moved to renew the charter for three years, instead of the five allowed by statute. If the school met the conditions in the Corrective Action Plan the charter could be extended to the full five years: apparently a non-controversial and reasonable request.

Chancellor Rosa, Vice –Chancellor Brown and others spoke into opposition to Dr. Collin’s motion!! It was defeated 10-7.

Why would the leaders of the Board turn down a request that will have no negative impact to the school, except, if the school fails to comply with the Corrective Action Plan?

Is Dr. Collins too outspoken at Regents Meetings? Is she being punished? Are charter schools in Buffalo being favored over public schools?

There are currently 19 charter schools in Buffalo with more in the pipeline – 9,000 students and charter funding comes out of the Buffalo School budget.

(9,000 x $12,000 per student = $108,000,000), not a paltry sum, especially in a district that even before the pandemic was fiscally challenged.

Later in the meeting three New York City charter schools were on the agenda, one of the schools wanted to add high school grades; although there is a moratorium on the creation of new charter schools State Ed staff interpreted the law as allowing grade  expansion, in my opinion, an attempt to circumvent the law and should have not been allowed by the state.

The math scores in the school were in the “far below standard” category, ninety percent of teachers were “teaching out of their certification area,” the state average is eleven percent and the register in the sixth, seventh and eighth grade, was sharply reduced, from 71 (6th grade), to 46 (7th grade) and 29 (8th grade): what happened to the kids?  In addition the school SWD and ELL students are far below the district averages.

Why did the NYC Department of Education approve the application?  Why did the SED approve the application?

The school has a lobbyist  who was a college roommate of Assembly Speaker Carl Heastie. I’m sure that’s only a coincidence. btw, who paid the lobbyist?

In spite of objections from some Regents members the SED lawyer bundled all three schools together instead of decoupling and voting separately.

Regent Cashin made a motion: a moratorium on approval of new charters and the grade expansion of existing charter schools for the remainder of the COVID emergency.  She explained that with sharp cuts in district budgets, with districts facing layoffs and disruptions, to transfer money from public schools budgets to charter school budgets was unconscionable. The SED lawyer ruled her motion was “out of order.”

Any member of the Board can make a motion at any time. The Board should vote on whether to place the motion on the agenda. The Board “owns” the motion, not the lawyer, who is not a Board member.

If the lawyer meant the motion was not “germane” he was still wrong. If he was serving as a parliamentarian he gives advice to the chair, he does not participate in the debate, or make determinate decisions

The action of Regent Brown, who was chairing the committee and the lawyer, simply has a noxious aroma.

I’m disappointed in the actions of the “majority.” Regents Collins and Cashin are passionate supporters of public schools, both have long distinguished careers, in my view they were treated shabbily.

In fact, the New York City Affinity District  allows for the same level of flexibility as charter schools, and, schools within the Affinity cluster are far more “innovative” than any charter.

Charter Schools have become an anachronism.

We should “fold” charter schools into autonomous clusters within school districts, that would require a change in the law.

And the Next New York City School Chancellor Will Be ………

I understand that in an office across the city a “chancellor retirement date poll” has been established. I hope someone selects a date after November, 2021; in spite of the speculation, Farina may not be seeking warmer winter climes

Of course the rumors have been rampant for years, the first rumor: she’s only staying until a “permanent” chancellor is selected, that was almost four years ago.

New York City is a mayoral control city, the 2002 law created a central board, called the Panel for Educational Priorities (PEP), with a majority appointed by the mayor; technically the school board appoints the chancellor, in the “real” world the choice is solely that of the mayor. There is no required consultation, no “advice and consent” by the City Council. Last time round the mayor and his top advisors held interviews for chancellor in off-the-grid locations; wholly within the law.

On Tuesday, November 7th Mayor de Blasio, Comptroller Stringer and Public Advocate James will be reelected with a historically low voter turnout. The only election of interest, for leader of the City Council, only has fifty-one voters – the members of the  council. The council leader – the speaker – is the second most powerful elected office in the city.

The only requirement to be chancellor is state certification as a superintendent – and the Board of Regents has the authority to waive the requirement. Under Mayor Bloomberg, all three chancellors, Joel Klein, Cathy Black and Dennis Walcott, required waivers. It is highly unlikely that the current Board of Regents would grant a waiver.

If the current chancellor retires one of names that the mayor might consider, Deputy Mayor Richard Buery, is not qualified under the law and would require a waiver.

Let’s speculate:

An easy choice: Deputy Chancellor Dorita Gibson.

Gibson, a Board/Department of Education lifer has worked her way up through the system. It would be a seamless transition, not controversial, and would result in the continuation of the current policies.

A higher profile choice is Rudy Crew, a former chancellor and current leader of Medgar Evers College in Brooklyn. The Department of Education, the P-12 school system has never been linked to CUNY, the community and four-year colleges. Crew might make sense if the mayor envisions a seamless P-16 school system.

Three senior members of the Board of Regents have lengthy and laudatory experience in the New York City school system as well as a firm understanding of the links between the city and the state. Regents Chancellor Rosa has been a breathe of fresh air, outspoken, highly collaborative, and has created a revitalized Board. Regent Cashin, a highly successful superintendent in the poorest section of the city, beloved by parents, a tireless worker with the ability to craft collaborative solutions including diverse interests, Regent Young, also a former superintendent has led the New York State My Brothers Keeper initiative, the first in the nation, aimed at improving outcomes for young men of color.

An academic and more recent deputy chancellor, Shael Suransky is currently the President of Bank Street College,

And, we can’t forget that former commissioner and former US secretary of education John King is hanging out at a Washington think tank, although I doubt it would be a politically viable choice.

How will de Blasio make the decision? What are the considerations?

On the day after the election de Blasio becomes a lame duck mayor, term limited, and is looking past city hall. The next four years will not be easy; Washington is making drastic cuts in the budget and the only question is how drastic. The city and the state will take deep hits; Medicare, and a host of other health care related cuts, education cuts and cuts across the entire budget. And this is only the first of the Trump budgets. The last four years the city’s budget outlook has been rosy, high rise, market rate buildings mean high income tax payers, tourism at all time highs, crime rates at all time lows, and a flow of “first round draft choice” immigrants. The stock market continues to spiral upwards to incredible heights.

A stock market sell off, continued Trump budget cuts, a jittery economy could bring a downturn in city revenues with cuts to city services. The City Council is far to the left with a hunger for increased city services, restrictions on market rate construction and a host of projects the mayor, up until now, has turned aside.

What does the mayor want to see as his legacy and his future? Can the city continue to prosper under Trump policies?

As we move closer to the 2018 midterms the democrats will work to take back one or both houses of Congress, and, the cavalry charge for the democratic presidential candidates will emerge, with a dozen or more democrats and who knows what will happen on the republican side.

Does de Blasio see himself as the leader of the national democratic progressive movement? Beyond his successes in New York City?

de Blasio can urge Farina to remain, if unsuccessful select a “safe” chancellor, akin to Farina, or, a higher profile innovator, whatever that means?

In this turbulent world of a “tweet” presidency, the future is, to be kind, uncertain.

Maybe de Blasio has a “baton in his knapsack,” and sees himself being promoted to a much higher leadership position with a headquarters at 1600 Pennsylvania Avenue.

ESSA, Next Generation Standards, Curriculum: The Beginning of a Trip Up a Steep Learning Staircase

Once a month on a Monday morning the seventeen members of the Board of Regents trickle into the ornate Regents Room in Albany. A long table stretches across the center of the room, the members sit along both sides along with the commissioner; a video screen in one corner and automated cameras (the meetings are live streamed). The coffee is strong!!  Three rows of folding chairs surround the table: journalists, State Ed staff, lobbyists, advocates for some issue on the agenda, an occasional legislator, and me. Most of us know each other, at least by sight. On the walls portraits of bearded white men, the many chancellors who have led the Board of Regents since the origin of the Board in the late eighteenth century.

Slavery ended in New York State in 1827, I wonder if any of the first chancellors owned slaves?  (For another day)

The meeting begins with a sort of invocation. The chancellor, or other board member, muses about the role of the board, the million plus students, parents, what the member thinks and/or what should guide their decisions.

The first order of business on Monday was the approval of the ESSA Plan, all hundreds of pages.

ESSA fatigue had set in, there was very little discussion. The year long effort is off to Washington with a decision by the feds expected in early 2018.

The meeting moved upstairs to the P-12 Committee and  a discussion of the Next Generation Standards, aka Common Core 2.0. The SED has been juggling the standards for two years. Hundreds of teachers, school leaders, college folk and SED staff have added and subtracted from what was the Common Core. I sat through an offsite meeting of teachers a few months ago. The very engaged teachers were totally committed, parsed words and phrases, and, I wondered: do classroom teachers, the ordinary Joe’s and Jane’s ever look at the standards?

In the discussion Regent Cashin, who was a teacher, a staff developer, a principal and a superintendent, asked a simple question:  Is there a curriculum that emerges from the standards?  The commissioner responded: curriculum is the responsibility of the school and/or school district and suggested that the BOCES centers, the regional State Education Department Support Centers could work with their surrounding school districts. In New York City the current leadership has been promising a curriculum for years.

Regents Cashin related that twenty schools in her district had used the Core Knowledge Curriculum with outstanding results. (The Joel Klein driven Board of Education did not renew the funding).

While the Common Core and it’s spin offs have dominated discussion for the last few years the importance of curriculum has emerged.

Charles Sahm in Knowledge Bank/US News wrote,  “A Compelling Case for Curriculum: Growing Evidence Suggests High Quality Curriculum is a Key Component of Student Success .”

One of the odd features of education policy is that while a plethora of research exists on the effects of systemic reforms (e.g., class size, charter schools, teacher and school accountability mechanisms), on student achievement there is very little data on whether curriculum – what kids are actually being taught – makes a difference.

 As Rebecca Kockler, Louisiana’s assistant superintendent of academic content, explained at the Hopkins/Hunter forum, over the past four years the state has reviewed more than 100 curricular programs according to their alignment with state content standards. The state leaves it up to districts to select curricula but helps them make informed decisions and facilitates professional development for the most highly rated curricula. Louisiana keeps track of what curricula districts are using and about 80 percent now employ materials from the state’s top rating tier. The state’s emphasis on curriculum appears to be generating results. Louisiana fourth graders achieved the highest growth among all states on the 2015 NAEP and the second highest in math.

Louisiana doesn’t write curriculum, they assess the alignment of curriculum to state standards on a public site.

Chester Finn, in Education Next, (“Curriculum Becomes a Reform Strategy”) hits the nail on the head,

Curriculum … is generally left to districts, which frequently leave it to individual schools and often to individual teachers or departments within them. When that classroom door closes, Ms. Smith and Ms. Gonzalez can teach pretty much whatever they want, using pretty much whatever materials they want, subject only to budgetary constraints, what’s in the “bookroom,” how fast are their internet connections, and what’s apt to be on their pupils’ end-of-year state test, which of course doesn’t exist for many subjects and high school courses.

New York State points with pride to the curriculum modules on the open source Engage NY web site. Unfortunately the modules are not aligned with current shifting standards; in New York, the state has spent the last two years amending the standards and will spend another set of years rolling out the standards. In other words, “ever-changing” standards, not aligned to modules and not aligned to state tests.

There is an increasing body of research that points to curriculum as the key to increasing student achievement.

Finn concludes,

  • the cumulative impact of a well-formulated curriculum over several years can be very large indeed.
  • “Changes in curriculum are relatively cost-neutral.” In other words, this is a low-budget reform. A powerful curriculum isn’t more expensive than a weak one.

Traditionally the New York City Labor Day parade takes place the Saturday after Labor Day. I met up with the UFT group on 47th Street waiting for our turn to march up Fifth Avenue. It was a spectacular day. For a couple hours you catch up with friends and make new friends. I chatted with teacher after teacher, did they know that New York State had standards? If so, did the standards impact their lesson planning and instruction? The answer was universal: they taught whatever program the school used, maybe Lucy Calkins, Teachers College Reading and Writing Project or Lucy West  or Singapore Math  or even ED Hirsch Core Knowledge or whatever the principal and/or the superintendent is partial to, in other words, the flavor of the day.

In high schools the curriculum is frequently driven by the contents of the book room.

I know this is radical, but, if we’re going to test kids wouldn’t it be a good idea to test them on the content that is actually taught?

What have we learned:

* We really good at crafting a plan, a high level of engagement across the state, every stakeholder having input, using some of the finest minds in the country to guide the process; however, will the implementation of the plan change outcomes for low performing kids and schools? Can ESSA overcome the impact of poverty, funding inequities, corrosive politics at the national and local levels?

* In spite of the federal law requiring testing state educational leaders are beginning to have doubts over the efficacy and impact of the state tests. The opt-out parents are clearly impacting thought across the state.

* Hopefully, now is the time to actually begin to explore alternatives to the traditional standardized tests

A number of states (for example New Hampshire) are piloting performance-based assessments. The Stanford Center for Assessment, Learning and Equity (usually referred to as SCALE) partners with school districts to create and implement performance assessments. New Hampshire is in the fourth year is an expanding pilot, partnering with 2Revolutions, an education design lab, embedding performance assessments and working with teachers to change the practice and culture of teaching and learning.

For some the submission of the ESSA plan is viewed as a major achievement, for me, a first step up a long and steep staircase, without handrails.

Fixing Teacher Preparation in New York State: Why Collaborative Processes Improve Outcomes.

How should we prepare prospective teachers for the classroom?

Law schools require a three-year sequence of classes and culminates in an examination – the bar exam.  The exam is not an accurate predictor of success or competence, it is the badge that the legal profession requires for entry.

The Office of the Professions within the New York State Department of Education (NYSED) licenses about fifty different professions. From medicine to veterinarian  to massage therapist to speech language pathologist, each has specific requirements and the state issues licenses/certifications that are required for practice.

The licensing process sets a minimum bar for entry into a profession.

State Ed approves colleges and university courses of study and requires terminal exams. The NYSED website lays out the step by step process and before John King required two examinations, the LAST and the ACT-W, the pass rates were in the high 90 percents.

When David Steiner, who had an excellent relationship with the education community, especially the unions, precipitously left his deputy John King became the commissioner.

The Common Core and the Common Core testing “pushed off the end of the diving board” approach has been well documented. Proficiency rates (aka pass rates) moved from 2/3 passing to 2/3 failing. Opposition grew into the Opt -Out Movement, one in five students opted out, and the opt-outs are heavily concentrated in suburban communities: the better to pressure the local electeds. The Long Island Opt-Out Facebook page has over 20,000 “friends.”

What had not received adequate coverage is the King imposed changes to teacher preparation certification requirements. King dumped the two exams and replaced them with four exams without any consultation with college instructors or deans.

The new exams are the edTPA, Educating All Students (EAS), Academic Literacy Skills Test (ALST) and the Content Specialty Test (CST) in the area of specialization.  At colleges the new requirements created chaos, suddenly colleges were turned into test prep mills, new exam passing rates fell sharply, many students were not completing the cycle of exams and the state instituted safety nets in an attempt to salvage and defend the flawed system. If I was teaching a course for superintendents on policy creation and implementation I would use the  teacher prep policy changes as an example of how well-intended changes can crash without a carefully crafted collaborative plan; and, I would emphasize the word collaborative.

There is an immense literature on organizational change: the number one rule, “participation reduces resistance.”

A year or so ago the new chancellor and the new state commissioner began to rebuild the relationships: teachers, legislators, parents, the governor, trying to craft policies that addressed the myriad issues confronting schools.

Betty Rosa, the new chancellor is the leader of the policy board, the Board of Regents. Rosa chose Regents Cashin and Collins to co-chair the Higher Education Committee. Regent. Cashin, a career educator in New York City and Regent Collins, with a nursing,  background from Buffalo.

Over the last year the chairs of the Higher Ed Committee have held about ten forums across the state (I attended two of them). Hundreds of college teachers and students participated, wide ranging discussions, a few panels were live streamed. Deans of colleges of education met with the Higher Ed Committee, the union, the  UUP (United University Professions) played a crucial role. An edTPA Task Force was formed, co-chaired by a high level SUNY administrator and a vice president of the UUP.

At the Monday. February 13th Regents Meeting [Meeting canceled due to blizzard conditions] a proposal will be put forth.

The Academic Literacy Skills Test (ALST) will no longer be required and a revised safety net will be in place for the edTPA .

This is not the end of the process, the ed TPA Task Force will continue to review the teacher preparation requirements,  especially the student teaching requirements that vary widely from college to college.

The King approach: to push changes through the Board of Regents without any consensus from the field, from the folks who are expected to carry out the edict frequently dooms the plan.

Enrollment rates in college preparation programs have plummeted from 20% to 40% across the state.  Troubling numbers of students are not completing the exams and not seeking state certification – perhaps seeking employment in other states or in charter schools.

Consensus does not mean unanimity:  at some point in a consensus-building process the leadership has to move to implementation. I fully expect the Board to approve the actions, a comment period, final action later in the Spring, and, a continuing process to explore and revise the teacher preparation pathway.

Yes, we want to assure that teachers are adequately prepared for the classroom. We don’t know whether the exams assure competence, we cannot predict classroom outcomes based on college or exam grades. Teaching is part art and part skill. The revised process appears to be a major step in the right direction, but, only a step.  Are students from some colleges more successful than students from other colleges, and, if so, why? Does teacher diversity or gender impact student learning?  How many weeks of student teaching is the “right” amount? Exploring and fine tuning the teacher prep process is ongoing. The required course of study and the exams provide minimum requirements, akin to the legal profession bar exam.

As teachers we know we will always have to strive to get better, first year or tenth year or twentieth year there are always new skills, if we stop learning we atrophy.

Back to that course for superintendents: I would ask Regents Cashin and Collins to lay out the process that they followed,  Building consensus can be slow, frustrating, at times filled with conflict, personality can get in the way of process, there will be wrong turns, and, eventually the leadership must bring the process to a conclusion. Everyone will not satisfied and some may throw stones.  Remember what Churchill said about democracy: “Democracy is the worst form of government, except for all the others.”

Regents Cashin and Collins deserve accolades for correcting a broken process by including all the folks involved in the day to day preparation of new teachers in the process and having the patience and understanding to continue to seek to improve teacher preparation as we move forward in New York State.

Who Sets Education Policy in New York State: The Governor or the Board of Regents? Should Education Policy Reflect the Views of the Governor or Parents, Teachers and Principals?

“We, the undersigned, have been empowered by the Constitution of the State of New York and appointed by the New York State Legislature to serve as the policy makers and guardians of educational goals for the residents of New York State. As Regents, we are obligated to determine the best contemporary approaches to meeting the educational needs of the state’s three million P-12 students as well as all students enrolled in our post-secondary schools and the entire community of participants who use and value our cultural institutions” (Comments by seven members of the Board of Regents)

The New York State Board of Regents is the oldest state education policy board in the nation, established in 1794 as part of the state constitution. The current 17-member board is “elected’ by a joint meeting of the State legislature. The selection as Regents was an honorific, a reward for long service in the state. Members served term after term in anonymity, met monthly from September to August, selected a commissioner and set policy, generally the policy originated with the commissioner. Typically the commissioner was a state superintendent with long and distinguished service.

All that changed with the election of Merryl Tisch to replace Bob Bennett as chancellor. The quiescent board became an activist board under the leadership of Tisch. An outsider, David Steiner was selected as commissioner, a report was commissioned that exposed the state testing program, and, with the resignation of Steiner and the appointment of John King the board pursued aggressive polices championed by the new commissioner. In line with the Arne Duncan game plan one major initiative after another was approved by the Regents, frequently over the objections of Regents Cashin and Rosa.

In order to qualify for the Race to the Top grant the state entered into a long negotiations with the state teacher and principal unions and an agreement was reached – called the Annual Personnel Performance Review, aka, APPR, teachers and principals would be assessed annually using a combination of student progress on standardized tests, locally negotiated measures of student achievement and supervisory observations.

In spite of trepidation the APPR plan was benign, with exceptions in a few districts, the overwhelming percentage of teachers received “highly effective” and “effective” scores and only 1% received ” an ineffective score.

The governor was displeased. Last spring the governor accepted millions in charter school campaign contributions and forced New York City to either co-locate charters in public schools or pay the rent for non-school space. Teacher anger grew, the teacher union made no endorsement for governor and it was clear that many teachers in the Democratic primary voted for Zephyr Teachout, an unknown law professor from Fordham. While Cuomo won handily it was not the landslide he anticipated, and, again, in the November general election Cuomo won, not by the landslide he had clearly expected.

On December 18th, barely six weeks after the election Jim Malatras, the governor’s chief of operations penned an accusatory letter to chancellor Tisch and commissioner King. The letter listed a series of condemning questions, demanding responses, and threatened to take over the policy-making role of the board.

As you know, Governor Cuomo has little power over education, which is governed by the Board of Regents, The Governor’s power is through the budget process and he intends the reforms during that process.

A few weeks later chancellor Tisch and acting commissioner Berlyn responded meekly; agreeing with the accusation of Cuomo through Malatras.

Differentiation is a necessary component of any evaluation system intended to
support professional development and growth. However, as the Governor has previously indicated, changes in State law are necessary in order to achieve better differentiation and to fulfill the goal of a Statewide evaluation system that identifies those who are excelling so that they can be mentors for their colleagues, identifies those who are struggling so they can get support to improve, and informs high‐quality professional development for all educators.

During the last hours of the budget process the Governor did exactly what he threatened; he forced through a totally new teacher evaluation system based on a Massachusetts model known as the “Matrix.”

The board convened an “Education Learning Summit,” and an all-day series of speakers, experts and stakeholders, to express opinions. Three of the four experts were critical of the use of student growth data for high stakes teacher assessment.

At the May Regents meeting acting commissioner Ken Wagner outlined a 56-page proposal to implement the new teacher evaluation law, although, the reconstituted board was much less sanguine; the four newly appointed Regents and the original critics, expressed displeasure with the new proposals.

Seven members of the board, let’s use Diane Ravitch’s term and call them the dissidents, objected to the role of the governor and outlined an alternative plan (Read Ravitch’s blog post here).

On Monday the board convenes in Albany, under the current law the board must turn the law into regulations. The guidelines introduced by the “dissident” seven directly challenges the December 18th Malatras letter.

The law clearly gives the board substantial leeway to establish regulations; will the remainder of the board support the dissident seven, reject their assertions, or find another path?

The Board of Regents, for the first time in anyone’s memory is asserting itself and reminding the governor that the state constitution grants to the Regents, not the Governor, the power to determine educational policy.

Unfortunately the P-12 Committee, the meeting at which the action will take place is not webcast. I will be tweeting (@edintheapple) – as fast as my fingers can “tweet.”

Maybe, just maybe, a brave group of board members will listen to their constituents and return education to parents and educators.

Position Paper Amendments
to Current APPR Proposed Regulations

We, the undersigned, have been empowered by the Constitution of the State of New York and appointed by the New York State Legislature to serve as the policy makers and guardians of educational goals for the residents of New York State. As Regents, we are obligated to determine the best contemporary approaches to meeting the educational needs of the state’s three million P-12 students as well as all students enrolled in our post-secondary schools and the entire community of participants who use and value our cultural institutions.
We hold ourselves accountable to the public for the trust they have in our ability to represent and educate them about the outcomes of our actions which requires that we engage in ongoing evaluations of our efforts. The results of our efforts must be transparent and invite public comment.
We recognize that we must strengthen the accountability systems intended to ensure our students benefit from the most effective teaching practices identified in research.
After extensive deliberation that included a review of research and information gained from listening tours, we have determined that the current proposed amendments to the APPR system are based on an incomplete and inadequate understanding of how to address the task of continuously improving our educational system.
Therefore, we have determined that the following amendments are essential, and thus required, in the proposed emergency regulations to remedy the current malfunctioning APPR system.
What we seek is a well thought out, comprehensive evaluation plan which sets the framework for establishing a sound professional learning community for educators. To that end we offer these carefully considered amendments to the emergency regulations.
I. Delay implementation of district APPR plans based on April 1, 2015 legislative action until September 1, 2016.
A system that has integrity, fidelity and reliability cannot be developed absent time to review research on best practices. We must have in place a process for evaluating the evaluation system. There is insufficient evidence to support using test measures that were never meant to be used to evaluate teacher performance.
We need a large scale study, that collects rigorous evidence for fairness and reliability and the results need to be published annually. The current system should not be simply repeated with a greater emphasis on a single test score. We do not understand and do not support the elimination of the instructional evidence that defines the teaching, learning, achievement process as an element of the observation process.
Revise the submission date. Allow all districts to submit by November 15, 2015 a letter of intent regarding how they will utilize the time to review/revise their current APPR Plan.
II. A. Base the teacher evaluation process on student standardized test scores, consistent with research; the scores will account for a maximum of no more than 20% on the matrix.
B. Base 80% of teacher evaluation on student performance, leaving the following options for local school districts to select from: keeping the current local measures generating new assessments with performance –driven student activities, (performance-assessments, portfolios, scientific experiments, research projects) utilizing options like NYC Measures of Student Learning, and corresponding student growth measures.
C. Base the teacher observation category on NYSUT and UFT’s scoring ranges using their rounding up process rather than the percentage process.
III. Base no more than 10% of the teacher observation score on the work of external/peer evaluators, an option to be decided at the local district level where the decisions as to what training is needed, will also be made.
IV. Develop weighting algorithms that accommodate the developmental stages for English Language Learners (ELL) and special needs (SWD) students. Testing of ELL students who have less than 3 years of English language instruction should be prohibited.
V. Establish a work group that includes respected experts and practitioners who are to be charged with constructing an accountability system that reflects research and identifies the most effective practices. In addition, the committee will be charged with identifying rubrics and a guide for assessing our progress annually against expected outcomes.
Our recommendations should allow flexibility which allows school systems to submit locally developed accountability plans that offer evidence of rigor, validity and a theory of action that defines the system.
VI. Establish a work group to analyze the elements of the Common Core Learning Standards and Assessments to determine levels of validity, reliability, rigor and appropriateness of the developmental aspiration levels embedded in the assessment items.
No one argues against the notion of a rigorous, fair accountability system. We disagree on the implied theory of action that frames its tenet such as firing educators instead of promoting a professional learning community that attracts and retains talented educators committed to ensuring our educational goals include preparing students to be contributing members committed to sustaining and improving the standards that represent a democratic society.
We find it important to note that researchers, who often represent opposing views about the characteristics that define effective teaching, do agree on the dangers of using the VAM student growth model to measure teacher effectiveness. They agree that effectiveness can depend on a number of variables that are not constant from school year to school year. Chetty, a professor at Harvard University, often quoted as the expert in the interpretation of VAM along with co-researchers Friedman & Rockoff, offers the following two cautions: “First, using VAM for high-stakes evaluation could lead to unproductive responses such as teaching to the test or cheating; to date, there is insufficient evidence to assess the importance of this concern. Second, other measures of teacher performance, such as principal evaluations, student ratings, or classroom observations, may ultimately prove to be better predictors of teachers’ long-term impacts on students than VAMs. While we have learned much about VAM through statistical research, further work is needed to understand how VAM estimates should (or should not) be combined with other metrics to identify and retain effective teachers.”i Linda Darling Hammond agrees, in a Phi Delta Kappan March 2012 article and cautions that “none of the assumptions for the use of VAM to measure teacher effectiveness are well supported by evidence.”ii
We recommend that while the system is under review we minimize the disruption to local school districts for the 2015/16 school year and allow for a continuation of approved plans in light of the phasing in of the amended regulations.
Last year, Vicki Phillips, Executive Director for the Gates Foundation, cautioned districts to move slowly in the rollout of an accountability system based on Common Core Systems and advised a two year moratorium before using the system for high stakes outcomes. Her cautions were endorsed by Bill Gates.
We, the undersigned, wish to reach a collaborative solution to the many issues before us, specifically at this moment, the revisions to APPR. However, as we struggle with the limitations of the new law, we also wish to state that we are unwilling to forsake the ethics we value, thus this list of amendments.
